There is potential criminal liability for entering into a contract for an illegal purpose and civil liability for a landlord or tenant if a marijuana-related activity on the premises interferes with the quiet enjoyment of neighboring tenants or constitutes a public or private nuisance under statutory or common law, even if the activity otherwise complies with state marijuana laws.

California Approves First Commercial Cannabis Landlord Insurance Coverage

But last week, the California Department of Insurance announced that it has approved a Lessor’s Risk policy for landlords renting to commercial cannabis tenants that will be issued by California Mutuals.
